1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and AfroJobs ("we," "us," or "our") governing your access to and use of our website, mobile application, and related services (collectively, the "Service"). AfroJobs is an independent subsidiary of KrumaLabs LLC Portfolio, a holding company group.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

AfroJobs is a platform that connects job seekers with employers in Africa. Our Service enables:

  • Job seekers to create profiles, search for job opportunities, and apply for positions
  • Employers to post job listings, search for candidates, and manage applications
  • Both parties to communicate and facilitate the hiring process

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3.2 Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. User Conduct and Responsibilities

You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Post false, misleading, or fraudulent information
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, abuse, or harm other users
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Collect or harvest information about other users without consent
  • Use the Service for any illegal or unauthorized purpose
  • Post discriminatory, offensive, or inappropriate content
  • Violate intellectual property rights of others

5. Job Postings and Applications

5.1 Job Postings

Employers are responsible for the accuracy and legality of their job postings. You agree that:

  • Job postings must comply with all applicable employment and anti-discrimination laws
  • You will not post jobs that require payment from applicants
  • You will not post fraudulent, misleading, or illegal job opportunities
  • You are responsible for the hiring decisions and employment relationships

5.2 Applications

Job seekers are responsible for the accuracy of their applications and profile information. You agree that:

  • All information provided is truthful and accurate
  • You have the right to work in the location specified
  • You will not submit applications containing false or misleading information
  • You understand that employers make independent hiring decisions

6. Intellectual Property Rights

6.1 Our Content

The Service and its original content, features, and functionality are owned by AfroJobs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of content you submit, post, or display on the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:

  • Use, reproduce, modify, adapt, and publish your User Content
  • Display and distribute your User Content on the Service
  • Use your User Content for marketing and promotional purposes

You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third-party rights.

7. Payment Terms

Certain features of the Service may require payment. If you purchase a subscription or service:

  • You agree to pay all fees associated with your purchase
  • Fees are charged in advance on a recurring basis (for subscriptions)
  • All fees are non-refundable unless otherwise stated or required by law
  • We reserve the right to change our pricing with notice
  • You are responsible for any taxes applicable to your purchase
  • We may suspend or terminate your access for non-payment

8. Disclaimers and Limitation of Liability

8.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 No Guarantee of Results

We do not guarantee that you will find employment or suitable candidates through the Service. We are not responsible for the quality, safety, or legality of jobs posted or the accuracy of information provided by users.

8.3 Limitation of Liability

To the maximum extent permitted by law, AfroJobs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Employment-related disputes or decisions
  • Unauthorized access to or use of your account
  • Errors or omissions in the Service
  • Interruptions or cessation of the Service

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless AfroJobs, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, illegal, or harmful activity
  • Non-payment of fees
  • Extended periods of inactivity

You may terminate your account at any time by contacting us or using account deletion features. Upon termination, your right to use the Service will cease immediately. We may delete your account and data, subject to our Privacy Policy and applicable law.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.

11.2 Dispute Resolution Process

In the event of any dispute, you agree to first contact us to attempt to resolve the dispute informally. If we cannot resolve the dispute within sixty (60) days, you agree to resolve the dispute through:

  • Binding arbitration in accordance with the American Arbitration Association Rules
  • Waiver of any right to participate in class action lawsuits
  • Waiver of any right to a jury trial

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AfroJobs regarding the Service and supersede all prior agreements and understandings.
